It will not be an easy matter for peter to prove that indeed the ER staff played a role in his failed promotion. It was not a guarantee that he would be promoted in the first place. It was just a probability and it is possible his boss had other considerations. Worthy to note is the fact that the ER did not discuss his condition with the boss the information on his condition apparently reached him through other people, and hence it would be futile for evidence to be found.

Confidential information need to be stored in files and locked where no one will access them. Also, they can be stored electronically in computers with a password.

I think that a diagnosis of anxiety should be a concern for an employer. The health of employees influences the performance of any organization. For this reason, the employers need to ensure the stability of their workers.

According to Rothstein (2016), there is an exception to the HIPAA rules; especially the health of an individual is at risk. In this case, I would let the surgeon know about the patient’s alcohol history since the implications of the habit would weigh heavily on him.

I think that the case at hand could be considered both ethical and legal. The legality of the scenario arises at the point when I go against the HIPAA rules. On the other hand, the ethical aspect of it comes from the idea that I am mandated to provide the best possible type of care, while doing no harm.

Discussing my concerns with the daughter of the patient be violating HIPAA rules hence I would never do that.

My first responsibility will be to ensure that the patient is safe and is care for in the best possible way. I will make the surgeon believe that am reliable in giving information on the patient.
